Q: Can I get my Earnest Money returned if the house does not meet inspection because of building codes are not met?

A: Most contracts are written in such a way as to allow the buyer to receive the earnest money if the house does not pass an inspection. You should read your contract, though, to be certain. Ask a local attorney if you still have any doubts. You may want to be somewhat flexible about building codes. Because building codes are constantly changing, even homes built in recent years may not pass today?s building codes. If the home met codes when it was built, it is almost certainly grandfathered in.
